Background: This is multi-occupied flat in a converted house. The front of the flat is at ground level but the

sloping site means that the rear is below ground level. The flat comprises of three bedrooms (two at the front

and one at the rear), a shared bathroom, shared kitchen, and shared lounge. Each bedroom is separately let

to three individuals living as three single households.

Dwelling: The dwelling unit is the rear bedroom. The horizontal distance from the window and the garden

bank is around 1800mm, and the bank extends vertically up to around the head of the window. The owner of

the maisonette above the basement flat has constructed a timber decked “patio” / walkway area over the rear

basement well to connect up with the rear garden lawn. In addition, there is no window to the shared lounge,

with only borrowed light through the glazed door to the kitchen, and a standard electric pendant light.

Justification

The ground floor dwelling has no other possible means of access to the rear garden and has exclusive use

rights to that garden. This means that the only option while this dwelling remains in multi-occupation is to lowe

the ground level in front of the window and to the side to reduce shadowing, and to require re-design of the

walkway in open latticework to improve conditions but the likelihood would remain much higher than average.

Justification

Because of the decking and the garden the rear bedroom has very limited natural light and no view. The lack

of natural lighting means that artificial lighting will be required at all times of day and night. There is no direct

natural light to the shared lounge. Household tasks, reading and safely moving about the dwelling all

necessitate good levels of lighting. Natural lighting and reasonable views to the outside are required for

psychological health. These matters mean that the likelihood of an occupier of this dwelling suffering harm

over the next twelve months is considerably greater than the average.
